A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 19, 2017, the Defendant: (a) connected the Defendant’s home located in Hanam-si, Hanam-si, 103 Dong 401, to “D”; (b) posted a notice to sell Internet lectures; and (c) reported it to the victim E who visited the Defendant, “ID of the Internet lecture and the heading Kakao Kao 2717, to inform the Defendant of the Internet lecture and the heading Kao Kao Kao Kao Kao Kao Kao Kao Ka.”

However, since the defendant did not own the above right to attend the Internet lecture, the defendant did not have the intent or ability to transfer the lecture and the failure failure to hear the lectures to the victim.

As such, the Defendant, including by deceiving the victim and receiving KRW 130,00 from the victim’s agricultural bank account (F) in the name of the Defendant, received a total of six times from June 17, 2017 to July 6, 2017, a total of KRW 825,00 from six victims in the same manner, including the transfer of KRW 130,00 from the victim’s agricultural bank account under the name of the Defendant.

On July 4, 2017, 2017, the Defendant posted a letter “G 103-dong 401-dong 103-dong 401,” the Defendant reported on the “G Kafbook” bulletin board of the NV Internet Kaf, NV Internet (hereinafter “G 10-dong 103-dong 103-dong 401-dong 201-dong 2870, and reported it to the victim H, “First, he/she would inform the Internet lecture ID and password when he/she deposits the amount.”

However, the defendant did not have the above right to attend the Internet lecture and did not have any intention or ability to transfer the above ID and passwords normally even if he received sales proceeds from the injured party.

The Defendant, as such, by deceiving the victim, received 100,000 won from the victim, to the national bank account (I) in the name of the Defendant.
