피고인은 2014. 6. 16. 01:20경 경산시 B원룸 101호 피고인의 집에서, 평소 호감을 가지고 있던 피해자 C(여, 19세)으로부터 ‘앞으로 연락 하지말자’는 문자를 받자 화가 나, 피해자에게 “원나잇이라도 할래 , 섹스 싫어하는 여자도 있네, 레즈인 갑지, 안지 좀 됐고, 크고 몸 좋고 잘한다는데, 함만해봐라, 후회안할끼다 진심ㅎ, 닥치고 함 벌리라 그냥, 언니 있는데 앞에서 할래 ”라는 등의 문자메시지를 스마트폰 카카오톡을 이용해 약 1시간에 걸쳐 발송하였다.
