The defendant's appeal is dismissed.

1. The sentencing of the court below (4 months of imprisonment) is too large and unfair.

In full view of the fact that the Defendant had been punished several times due to driving without a license and committed the instant crime during the suspended execution period due to the violation of the Guarantee of Automobile Compensation Act, and other various circumstances, such as the Defendant’s age, sex, sex, environment, family relationship, motive, circumstance, means and consequence of the crime, etc., which are conditions for sentencing, and there is no special change in circumstances or circumstances that may change the sentencing of the lower court after the lower judgment, the sentencing of the lower court is unreasonable.

3. The Defendant’s appeal is dismissed in accordance with Article 364(4) of the Criminal Procedure Act, on the grounds that the appeal is groundless.
