Punishment of the crime

1. On February 15, 2019, the Defendant defraudation with the victim H in the name of the investment fund for the Gangseo-gu Seoul Metropolitan Government on the roads of the Gangwon-gu Military Office in Yeongdeungpo-gu, Seoul Special Metropolitan City. The Defendant made a statement to the effect that “Isky will make profits from the Defendant’s business of supplying Iskys SET, such as smuggling, food milk, and rice. If Iskys invest KRW 30 million in the business, Iskys will repay KRW 50 million until February 28, 2019.”
However, there was no fact that the defendant's will do business to deliver Iski ground, and the defendant thought that Iski ground will receive money from the victim to use it as living expenses, etc., and there was no intention or ability to pay the principal and investment profits promised to the victim properly.
The defendant acquired 30 million won from the victim through the Agricultural Cooperative Account (Account Number E) in the name of the defendant on the same day.
2. On March 15, 2019, the Defendant made a statement to the effect that “B is an attorney-at-law office, who is an attorney-at-law office, and will help the obligor check the balance, etc. of the passbook, and help the legal preparation and legal counseling so that he/she can receive a claim.”
However, in fact, the defendant was not the director of the office of the lawyer, and he thought that he will receive money from the victim to use it as living expenses, and there was no intention or ability to provide legal counseling as promised to the victim.
The Defendant received 300,000 won from the victim’s account in the name of the Defendant on the same day, and acquired 3,720,000 won through 10 times until April 11, 2019, such as the list of crimes in the attached list.
