1. Revocation of a judgment of the first instance;
2. Survivors’ benefits and funeral expenses that the Defendant provided to the Plaintiffs on June 2, 2017.
Reasons
1. The grounds for this part of the disposition by the court are as stated in Paragraph 1 of the reasoning of the judgment of the court of first instance, and thus, this part is cited in accordance with Article 8 of the Administrative Litigation Act and Article 420 of the Civil Procedure
2. Whether the instant disposition is lawful
A. After the promotion of the Minister of Justice on January 1, 2016, the deceased asserted that he/she had been in charge of the purchase, production, quality, human resources, accounting management, research, and development as a researcher for the development of his/her own products, and died of excessive tasks, regardless of usual work and holiday, low and night hours, and the occupational career and stress were accumulated.
Since there is a proximate causal relationship between the deceased’s death and his duties, the instant disposition should be revoked in violation of law.

C. 1) The Deceased worked at the instant workplace from April 22, 2009 to August 22, 2016. After promoting to the chief of department, the Deceased performed overall management of the production, development, quality, and inspection of semiconductor cell tape, and research and management of additional products, such as semiconductor film.
In addition, unlike the head of other department, the deceased has performed the tasks such as technical business for the customer, the submission of reports on business trips and improvement measures to solve the quality problems raised by the customer.
B) In March 2015, the business division to which the deceased belongs moved to a factory in the instant workplace, the increase in production workers and manufacturing process, and the increase in the number of personnel to be managed by the deceased, which led to the increase in the number of employees, most employees were at the lower age and work experience. C) As a day fixed work system, the deceased was set at eight hours per day average (excluding recess hours) and five days per week average, and the rest hours were set at 60 minutes per week and 30 minutes per week.
