The Defendants are not guilty.

Indictment

1. On June 18, 2012, at around 23:30 on June 18, 2012, Defendant A expressed an desire to drink with Defendant B, etc. on the Eju shop located in Busan Jin-gu, Busan, and expressed other customers “I am about the same year as that of the same year.” Accordingly, on the ground that the victim F (I am 50 years of age) is determined as “I am a guest, I am you will am? 2. Defendant B, at the time and place specified in paragraph (1), assaulted the victim G (44 years of age) who is the husband of the above victim F, by hand on the ground that the victim G (44 years of age) who was the husband of the above victim F mets the assault of the above Defendant A.

Judgment

Based on the police statement statement of G and F, the prosecutor acting on behalf of the prosecutor was prosecuted as assaulting the victim G, and the defendant B committed the assaulting of the victim G.

However, the witness F, G, and H are relatively decent statements that the victim F is not the defendant A but the defendant B.

피해자 G의 이마를 할퀸 사람에 관하여는 증인 F는 기억이 안난다고, 증인 G은 피고인 B이라고, 증인 H는 피고인 B은 확실히 아니라고 진술하여 조금씩 차이를 보이고 있기는 하다.

However, Defendant B, while assaulting the Victim B, took the victim G while she was frightened, and the victim G was found to have been avoided in the Ethma of the victim G, so the witness H’s testimony that Defendant B was not certain to assault the Victim G is relatively detailed and is the most reliable in line with the circumstances.

In full view of the above circumstances, the evidence presented by the prosecutor alone is sufficient to acknowledge the facts charged in this case that Defendant A assaults F and Defendant B assaults G.
