All judgment of the court below shall be reversed.
Defendant shall be punished by a fine of KRW 4,000,000.
The above fine shall be imposed on the defendant.
Reasons
1. According to the progress records of the case, the following facts can be acknowledged.
A. On August 30, 2011, the Defendant was sentenced to a fine of KRW 4 million for a violation of the Labor Standards Act at the Seoul Western District Court, which was the first instance court, which was the Seoul Western District Court (Seoul Western District Court 2010 and 1668), and filed an appeal with the Seoul Western District Court 201No963.
In addition, on August 14, 2012, the Defendant was sentenced to a fine of one million won in violation of the Labor Standards Act at the Seoul Central District Court (Seoul Central District Court Decision 2011 High Court Decision 61 Decided 201) and filed an appeal as Seoul Central District Court Decision 2012No. 2936.
B. The Seoul Central District Court 2012No. 2936 case was transferred to the Seoul Western District Court, and was consolidated into the said case 201No. 963 case (Seoul Central District Court 2012No. 2936 case). The Seoul Western District Court reversed all the lower judgment on February 7, 2013, and sentenced the Defendant to a fine of KRW 4 million.
Although the Defendant appealed to the Supreme Court, the Defendant’s appeal was dismissed on May 9, 2013 (Supreme Court Decision 2013Do2192).

The judgment subject to a retrial cites the summary of the first instance judgment’s evidence, which presented “the statement of the witness M in the fourth trial protocol,” as it is, as evidence of conviction on the facts constituting an offense subject to a retrial, thereby citing M’s testimony in the first instance trial court as evidence of conviction on the facts charged.
