A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Fraud;
A. On August 12, 2014, the Defendant’s account in which KRW 40 million is deposited as a tax issue is attached at the victim C’s residence located in the apartment unit B in Seongbuk-gu, Seongbuk-gu, Seoul Metropolitan City.
If only 3.5 million won is leased, the seizure will be terminated and the money borrowed shall be repaid immediately.
‘False speech' was made.
However, in fact, the Defendant did not have an account in which KRW 40 million was deposited, and there was no intention or ability to repay the money even if he borrowed money from the damaged party.
The defendant deceivings the victim as above and acquired 3,200,000 won from the victim, namely, from the victim, to the Saemaul Treasury account in the name of the defendant.
B. On August 26, 2014, the Defendant did not terminate the seizure of the account in which KRW 40 million has been deposited due to the delinquency in paying the card price in the said victim C’s residence.
If 5 million won is more than 5 million won, seizure may be terminated after 3 to 4 days, and when the seizure is terminated, the amount of money borrowed shall be repaid.
‘False speech' was made.
However, as above, the Defendant thought that he would use money as money for gambling from the victim, so even if he borrowed money from the victim, he did not have the intention or ability to repay the money.
As above, the defendant deceivings the victim as above and obtained cash 5 million won from the victim, i.e., the victim, who is the victim, from the victim.
2. On October 20, 2014, the Defendant, at the victim’s F office operated by Sungnam-gu, Sungwon-gu, Seoul Special Metropolitan City (Seoul Special Metropolitan City), borrowed G rocketing car, the victim owned, at a fee of 1.40,000 won for two days, and received the said car.
Defendant around October 21, 2014, while lending and using the said siren, was KRW 90,000,000,000,000,000,000,000,000,000,00 in and around the Hanwon Islands located in 265, Seowon-gun, Seowon-gun, Gangwon-do.
