A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

The Defendant is a person subject to enlistment in active duty service. On January 3, 2013, the Defendant received a notice of enlistment in active duty service under the name of the director of the Seoul Regional Military Manpower Office to enlistment in the Army Training Center in the city of Gangdong-gu Seoul on February 4, 2013 from the Defendant’s house located in B Apartment 101, 709, to the Army Training Center located in the city of 14:00 on February 4, 2013, the Defendant failed to enlist for more than three days
