1. The facts charged in the instant case [former Facts] The Defendant is the mother of D (Inn, third grade of elementary school) who is a student of Category C elementary school in Ansan-si, and the victim E (inn, 39 years of age) is the mother of the Victim F (in South and third grade of elementary school) who is a semi-student student like the above D during Ansan-si.

On July 19, 2019, the Defendant sent a text message to the effect that, on July 24, 2019, the election of the head of a class D, his/her his/her his/her father was deprived of his/her election and the said victim F was elected, the Defendant raised an objection to the effect that: (a) on July 24, 2019, the Defendant sent a text message, stating, “I would have to make son make a reasonable choice; (b) brought son’s meeting on the day before the election of the head of a group; and (c) raised son’s objection to the effect that the election of the head of a group was denied at the school level.”

피고인은 사실은 피해자 E이 아들인 피해자 F를 반장에 당선시키기 위해 반장선거 전날 파티를 연 사실이 없고, 위와 같이 담임교사에게 이의를 제기하여 담임교사가 피해자들이 파티를 여는 등 부정한 선거운동을 한 사실이 없다는 사실을 확인하였음에도, 이에 대해 제대로 알아보지 않고 위와 같이 마치 피해자들이 선거 전날 파티를 열어 반친구들의 환심을 사고 반장으로 뽑아 달라고 선거운동을 하였다는 취지의 소문을 내려고 마음먹고, 2019. 7. 24.경 경기 안양시 동안구 I에 있는 피고인의 주거지에서 학부모 J에게 “K한테 물어보니 선거전 파티때 F가 자기 반장선거 나갈꺼구 반장 되고 싶다고 말했데ㅋㅋ, 다신 이런 엄마의 강요가 아이들 선택권을 방해 해선 안된다는 거징~”이라는 내용으로 카카오톡 메시지를 보내고, 2019. 10. 1.경 학부모 L에게 전화로 "F가 공부를 잘해, 발표를 잘해, 뭘 하는데 걔가 왜 어떻게 반장이 되는데. 근데 그런 애가 그 전날에 반장 파티를 하고.
