A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The defendant is the victim B, C, D, E, F, and the electric cable manufacturing company G in the Chungcheong-gun G, Chungcheongnam-gun, the defendant has worked together at H.

1. On April 19, 2012, the Defendant made a false statement to the victim B, “If he/she lends too much money to him/her to conduct a business, he/she will dispose of the real estate located in Jeju-do and complete payment.”

However, in fact, the defendant's punishment did not need money because he did not operate his business, and there was no real estate owned by the defendant in Jeju-do and there was no intention or ability to pay money.

As such, the Defendant, by deceiving the victim, received KRW 10,000,000 from the victim to the single bank account under the name of the Defendant on the same day, and received KRW 40,000,000 as indicated in the list of crimes from around B of 2011 to January 15, 2013.

Accordingly, the defendant was given property by deceiving the victim.

2. On October 15, 2012, the Defendant committed the crime of fraud against the victim C at the H office of the said Dispute Resolution Co., Ltd., the Defendant made a false statement to the victim C, stating, “I will complete payment by disposing of the real estate located in Jeju-do if I lend the money so that our punishment is too difficult to conduct the business.”

However, in fact, the defendant's punishment did not need money because he did not operate his business, and there was no real estate owned by the defendant in Jeju-do and there was no intention or ability to pay money.

The Defendant, by deceiving the victim as above, received KRW 350,00 from the victim to the national bank account in the name of the Defendant on the same day. From around that time to October 15, 2013, the Defendant received a total of KRW 9,700,000 as indicated in Table 2.

Accordingly, the defendant was given property by deceiving the victim.
