A defendant shall be punished by imprisonment for four years.

그 후, 피고인은 같은 날 22:00경 가출하였던 피해자가 피고인의 집 창문 앞으로 찾아와 피고인과 피해자 슬하의 딸의 이름을 부르자, 이에 격분하여 위 부엌칼을 사진 촬영하여 그 사진을 피해자의 휴대폰으로 전송하면서 “나 식칼 샀으니 오지 마라. 오면 너 죽고 나 죽고 한번 해보자.”는 내용의 문자메시지를 보내고, 이를 무시한 피해자가 딸의 이름을 계속 부르자, 오른손에 코팅장갑을 착용하고 위 부엌칼의 칼날 부분을 바닥으로 향하게 하여 잡은 채 투명테이프로 위 부엌칼과 오른손을 감은 다음 그 모습을 사진 촬영하여 그 사진을 피해자의 휴대폰으로 전송하면서 피해자에게 “애들도 보지 말고, 나도 보지 말고, 오지 마라.”고 말하였다.

피고인은 같은 날 22:21경 피고인의 집 창문 밖에서 피해자의 목소리가 들리지 않고 인기척이 사라지자, 분이 풀리지 않는다는 이유로 위와 같이 오른손에 위 부엌칼을 쥔 채 투명테이프로 위 부엌칼과 오른손을 감고 이를 천주머니로 가린 채 집 밖으로 나간 후...
