The defendant's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal (misunderstanding of the facts) by the defendant's hand in contact with the victim, but the defendant did not injure the victim's shoulder.
2. In full view of the following circumstances acknowledged by the evidence duly admitted and examined by the lower court, the Defendant was fully recognized as having tightly pushed the victim’s shoulder, thereby cutting down the floor.
Therefore, the defendant's assertion is not accepted.
① Although the Defendant reversed the statement to the effect that he did not have the victim’s right to remain tightly when recognizing the fact that the Defendant was satisfe even a shouldered, the circumstances leading up to the reversal of the statement that could have been satisfed are not specifically presented.
② The CCTV images, which had taken the scene at the time of the crime of this case, had the victim close down into a large range of hands, and the hand of the defendant clearly contacted the body of the victim, and had the victim go beyond the floor (0:11). Furthermore, the defendant made a statement to the effect that the victim, who was going beyond the floor, is able to talk about the face of the victim (0:16). (3) The victim made a statement from the police investigation to the effect that the victim goes beyond the face of the victim, and this is consistent with CCTV images (16 pages of investigation records).
