1. The Plaintiff:
A. The Defendants are each indicated in the separate sheet Nos. 1, 2, 18, 17, 16, and 1 among the real estate listed in the separate sheet No. 1, 2, 18,
Reasons
1. Indication of claim;
A. On May 19, 2013, Defendant C leased each part of the building indicated in the order from the Plaintiff as the deposit amount of KRW 500,000,000 per month (19,000 per month), and the lease period of KRW 24 months, and thereafter, Defendant C resided with Defendant B, who was an infant.
B. On April 1, 2017, Defendant B leased each part of the building indicated in the order from the Plaintiff as the deposit amount of KRW 40,000, monthly rent of KRW 250,000, and the lease period of KRW 24 months. Since then, Defendant B did not pay any rent.
C. From January 2015 to May 2017, the Defendants unpaid the total electricity charges of KRW 1,326,520, the total electricity charges of KRW 1,989,790 x 2/3 (2/3 of the total electricity rates), the total water rates of KRW 581,820, the total water rates of KRW 1,745,480 x 2/6 (2/6 of the total water rates) and the total water rates of KRW 588,680, such as septic tanks and glass damage costs.
The Plaintiff terminated the above lease on the grounds of the delinquency in rent.
E. Therefore, the Plaintiff and the Defendants delivered each part of the building indicated in the order, and ② Defendant B paid damages equivalent to the rent or rent in proportion to 250,000 won per month from April 1, 2017 to the completion date of delivery of each part of the building indicated in the order, and ③ jointly and severally the Defendants are liable to pay damages for delay calculated at the annual rate of 2,497,020 won (electric charge 1,326,520 + 581,820 + 581,820 won + 580 won + 588,680 won such as septic tanks + 58,680 won such as septic tank costs) as requested by the Plaintiff, from May 27, 2018 to February 21, 2019, which is the day following the delivery date of a copy of the complaint, to the day of complete payment.
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
