1. The plaintiff's claim is dismissed.

1. Basic facts

A. 1) On December 16, 2008, E, the Plaintiff’s father, completed the registration of ownership transfer on the ground of sale and purchase on December 4, 2008, with respect to D major 456 square meters in Chungcheongnam-gun, Chungcheongnam-do. The said land was combined with F major 75 square meters on April 19, 2010, and was combined with D major 513 square meters on August 24, 2010 (hereinafter “D land”).

(2) The Plaintiff completed the registration of ownership transfer on April 29, 2010 with respect to D land on April 30, 2010.

나. I은 1984. 10. 20. D 토지에 인접한 경남 창녕군 J 대 456㎡(이하 ‘J 토지’라 한다) 및 위 토지 중 별지 도면 표시 28, 29, 30, 31, 28의 각 점을 순차 연결한 선내 ㈎ 부분 지상에 위치한 당시 미등기 상태였던 단층 농가주택(이하 ‘이 사건 건물’이라 한다)을 매수한 후, 1994. 3. 28. J 토지에 관하여 위 매매를 원인으로 한 소유권이전등기를, 1995. 6. 30. 이 사건 건물에 관하여 소유권보존등기를 각 마쳤다.

C. On December 27, 2016, the Defendant purchased 446/456 shares of J land and the instant building from I, and completed the registration of ownership transfer in its name on February 6, 2017.

On the other hand, from around 1945, there was a stone fence (hereinafter “the stone fence of this case”) installed on the line connecting each point of 12,27, 26, 25, 24, and 23 of the annexed drawing from around 1945 to the D land and J land, which connects each point of 12, 13, 14, 15, 23, 24, 25, 26, 27, 12 of the annexed drawing among D land due to the boundary, the part (b) 19m2 (hereinafter “the land in this case”) was used as the site of the building of this case, but I occupied the land in this case and the building and the land in this case from March 28, 199 to the day of completing the registration of ownership transfer on the J-land from February 6, 2017.
