A defendant shall be punished by imprisonment for four months.
Reasons
Punishment of the crime
1. The Defendant was entrusted with all of the above studio AM, AB, U, BD, and B E in Yangsan-si with respect to the above studio lease-related contracts, building management, etc. A.
On February 24, 2015, the Defendant made a false statement to the injured party BG that “The studio AM of this case will be awarded a lease contract with a deposit of KRW 10 million,” at the C Licensed Real Estate Agent Office located in Q Q Q in Gyeyang-si.
However, in fact, the defendant said that the above BF entered into a contract with 2 million won as monthly OO, and that the defendant thought that the difference of the deposit will be used by the defendant, so there was no intention or ability to harm the normal contract of the victim.
Nevertheless, the Defendant, by deceiving the victim as above, obtained KRW 10 million from the victim as a security deposit, and delivered KRW 2 million among them to BF, and obtained KRW 8 million from that time to February 23, 2017, and acquired KRW 68 million in total on four occasions, as shown in the list of crimes in attached Table, from that time.
B. Around the end of December 2015, the Defendant made a false statement to the effect that “BF of the above C Licensed Real Estate Agent Office (“BD lessee shall pay the bond,” and that “BD lessee shall pay the bond.”
However, it was not necessary to pay the security deposit to the lessee because the lessee of the above BD is not the lessee.
Nevertheless, the Defendant, as above, was informed of the victim’s deception from the victim on December 2, 2015 to February 2, 2017, and received KRW 20 million in total, including KRW 8 million, KRW 12 million, from the victim from the end of February 2015 to the victim.
2. Around August 11, 2016, the Defendant, at the above C Licensed Real Estate Agent Office, sold a single house in Yangsan City owned by the victim BH to BJ. Around March 201, the Defendant was an individual who was issued by BJ and kept the remainder of seven million won of the purchase price of the relevant land for the victim.
