The Defendants, other than Defendant M, shall share each of the shares listed in the attached Table in the attached Table among the 12,945 square meters of PP forest land in Gunpo-si.
Reasons
1. Facts of recognition;
A. 1) The Plaintiff owned the woodland in the name of the clan members of Suwon-si Q and Rdong, Suwon-si, and the Plaintiff purchased the tomb in accordance with the urban planning decision of Suwon-si, Suwon-si, and purchased the land in the land in the Gyeonggi-do Tri-do, Sinpo-gun, Gyeonggi-do, to transfer the tomb, and the purchase of the land in the name of the land so purchased. 2) On December 10, 1966, S purchased the land in the name of the Sinpo-Gun, Sin-gun, Sinpo-gun, Gapo-gun, 12,992 square meters (Spo-si P; hereinafter “the instant forest”). 3,838 square meters (hereinafter “Wed land”) on February 9, 1967 and the name of the land so purchased. 849 square meters (hereinafter “Sinpo-si, Ypo-si, Yan-gun, Yan-gun, and the land in each of the instant case”).
B. 1) On August 19, 1975, S completed the registration of ownership transfer of the instant land and W land in its name. On June 23, 1978, S completed the registration of ownership transfer for W land due to donation to Z, AA, AB, G, AC, and AD on June 23, 1978. 2) S entered into a contract for the exchange of W land between Z, AA, AB, G, AC, and AD on December 26, 1978, and completed the registration of ownership transfer for each of the instant land on February 12, 1979 with respect to one-six shares due to the above exchange.
3) On July 8, 2013, Defendant G created the creation of a mortgage over the maximum debt amount of KRW 270,000,000 for Defendant K, L, and M on the ground of the same day with respect to the portion of 1/6 out of the instant land (hereinafter “instant collateral security”).
(4) On August 23, 2013, Defendant K, L, and M applied for voluntary auction as to Defendant G G 1/6 of the instant land, and purchased the said shares in the auction procedure and completed each registration of ownership transfer on May 7, 2014.
5 Gunpo-si shall complete the registration of ownership transfer on August 20, 2015 with respect to the shares of the above defendant M and the shares of the above defendant K and L on August 21, 2015 due to the acquisition of each public site on the same day, and the relevant compensation on August 26, 2015.
