The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal (one year of imprisonment with prison labor, three years of suspended execution, and three years of probation) declared by the court below is deemed to be too uneasy and unfair.

The crime of this case was committed under the circumstances that the defendant purchased and sold philophones over several occasions and administered them, with a large amount of philophones handled by the defendant, and the crime of selling philophones is an act of spreading narcotics to the surrounding people, and there is a greater possibility of criticism. However, the prosecutor's assertion is without merit, as it is unreasonable, that the defendant committed all the crime of this case, and there was a record of the defendant being sentenced to the suspension of the execution of imprisonment for the same kind of crime in around 1998, but there was no record of being punished for the same crime, but there was no record of being detained for a considerable period of time after being detained for the crime of this case.
