A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

At around 12:22 on September 10, 2015, the name-free person phoneed to the victim C (n, 27 years of age) and misrepresented to the investigator of the Seoul Central District Public Prosecutor's Office, and reported the victim's "the person who suffered damage by opening the passbook. The victim (victim) can be a suspect. It connects to the "D" Internet website that the victim may become a suspect, and I see the case inquiry. All money in the passbook was collected in one passbook and cooperation with the investigation.

However, in fact, the name-based person was not the investigator of the Seoul Central District Prosecutors' Office but the victim was reported.

Nevertheless, as seen above, a person who was unaware of name made a false statement to the victim and caused the victim to enter personal information in the input book by accessing the Internet site in which the victim was informed of his/her name, and thereby, identified the victim's security card password, etc., and obtained the victim's personal information by being transferred KRW 43,500,000 from the Daegu bank account under the victim's name to the E company bank account (F) at around 14:30 on October 14, 2015, by allowing the victim to enter and change the information without authority in the computer or other information processing device, and then allowing the victim to process the information by using the information so discovered. On October 14:30, 2015, at around 15:28, 2015, he/she acquired the victim's name bank account (G) from the Daegu bank account under the victim's name to the 333.5 million won.

Defendant

A, on September 10, 2015, notified the namelightist of the defendant's account number to him/her of the number of the defendant's account, withdraws 33.5 million won in cash deposited at the bank counter of the new community credit cooperative in Seoul, around September 14:37, 2015, from the bank counter of the new community credit cooperative, as above, at around 15:55 on September 15, 2015, and then transferred to the above namelightist of the defendant's name to the above namelightist (K).
