A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 00:00 on May 29, 2020, the Defendant driven a F string car without obtaining a driver’s license from the roads in front of C in Kimhae-si, Kimhae-si, to the roads in front of E-ray in Kimhae-si, the Defendant driven a F string car without obtaining a driver’s license.

2. On September 10, 2007, the Defendant received a summary order of KRW 2,00,000 from the Changwon District Court to a fine of KRW 1,50,000 as a crime of violation of the Road Traffic Act. On July 1, 2015, the Changwon District Court received a summary order of KRW 3,50,000 as a fine for a crime of violation of the Road Traffic Act.

그럼에도 불구하고 피고인은 2020. 5. 29. 00:00경 김해시 G 앞에서 F 레조 승용차를 운전하던 중 주차된 차량을 들이받고 현장을 이탈하려고 하여, 112신고를 받고 출동한 경찰관으로부터 김해시 D에 있는 E 앞 사거리 도로에서 음주운전으로 적발되고, 당시 혀가 꼬이며 비틀거리며 얼굴에 홍조를 띠는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 김해중부경찰서 H 소속 경위 I으로부터 같은 날 00:08경, 00:13경, 00:18경, 00:23경, 00:28경 5회에 걸쳐 음주측정요구를 받고도 음주측정기에 입김을 불어넣는 시늉만 하는 등 정당한 사유 없이 경찰공무원의 음주측정요구에 응하지 아니하였다.

Accordingly, the defendant violated Article 44 (1) or (2) of the Road Traffic Act not less than twice.
