1. The defendant completed the acquisition by prescription on June 11, 1997 with respect to each real estate listed in [Attachment List 1 and 5] to the plaintiff.

1. Basic facts

A. The Yeongsan River Improvement Association was dissolved by the enforcement of the former Agricultural and Rural Infrastructure Corporation and Farmland Management Fund Act (Act No. 5759, Feb. 5, 199); the Korea Agricultural and Rural Infrastructure Corporation established on Jan. 1, 200 comprehensively succeeded to the rights and obligations of the Yeongsan River Improvement Association under Article 9 of the above Act; the Korea Agricultural and Rural Infrastructure Corporation changed its name to the Korea Agricultural and Rural Community Corporation, the former Korea Rural Community Corporation and Farmland Management Fund (Act No. 775, Dec. 29, 2005) pursuant to Article 3 of the Addenda of the former Agricultural and Rural Community Corporation and Farmland Management Fund Act (Act No. 9276, Dec. 29, 2008).

B. Each real estate listed in the separate sheet is used as the site of the Docheon Reservoirs (hereinafter “instant reservoir”) established in the 1944 by the Do Seocheon-gu, Gwangju mine, and on June 11, 1977, the mine group transferred the instant reservoir to the Plaintiff (YYYY) pursuant to Article 16 of the former Agricultural Community Modernization Promotion Act (repealed by Article 2 of the Addenda of the Farmland Improvement Cooperatives Act, Act No. 5077, Dec. 29, 1995; hereinafter the same shall apply), and thereafter, the Plaintiff occupied and managed the instant reservoir.

C. On November 1, 1995, the Defendant issued to the Plaintiff (YYYY) a certificate of registration of agricultural infrastructure with the Plaintiff as an agency for the installation and maintenance of the reservoir in this case.

On the other hand, the defendant completed the registration of ownership transfer on December 23, 1994 with respect to the real estate in the attached Tables 1 and 5 in which the registration of ownership transfer was completed under the name of Jeonnam New Co., Ltd. (the reason for the registration was the donation of September 23, 1994), the attached Tables 2 and 4 with respect to each real estate in which the registration of ownership transfer was completed under the name of Joseon Trust Co., Ltd. (the cause for the registration is the right of September 11, 1948), and the registration of ownership transfer on September 14, 2012 with respect to each real estate in the attached Tables 1 and 3.
