1. Defendant B’s KRW 189,186,440 as well as 5% per annum from January 14, 2012 to May 15, 2015 to the Plaintiff.

1. Basic facts

A. Defendant C is the owner and lessor of Jongno-gu Seoul Metropolitan Government 2nd floor building (hereinafter “instant building”) and Defendant C is a person who leased the instant building from Defendant C to operate the 1 and 2nd floor with the trade name “E”.

B. On January 14, 2012, at around 01:50, the Plaintiff saw the alcohol to the above main place and worked in the second floor room.

2. Claim against the defendant B

A. 1) In the context of Article 758(1) of the Civil Act, “a defect in the installation or preservation of a structure” refers to a situation in which a structure does not have safety ordinarily required according to its intended purpose. In determining whether such safety is satisfied, the determination shall be based on whether the installer or keeper of the structure has fulfilled his/her duty to take protective measures to the extent generally required by social norms in proportion to the risk of the structure.

(b) An accident resulting from a defect in the installation or preservation of a structure does not refer only to cases where only the defect in the installation or preservation of a structure causes the occurrence of the damage, but also to cases where the damage is incurred in conjunction with another person’s act or the act of the victim.
