From March 24, 2014, the J served as an operating manager in the H operation management office of the Korea Shipping Association G branch of the Korea Shipping Association, and Defendant C served as the head of the Korea Shipping Association G branch management office from April 1, 2010.

A provider of coastal passenger transportation services shall be subject to guidance and supervision on safe navigation from persons appointed by the Korean Shipping Association, and the captain of a passenger ship shall visit the operation management office before and after departure from the port of a passenger ship to exchange information necessary for safe navigation and receive instructions from the operation manager.

A navigation manager is a person to take necessary measures to ensure the safety of passenger ships, such as maintaining order in the entry into and departure from a port of a passenger ship, over the seating capacity of passengers, loading of cargo including a vehicle, engine and communication status, and checking the status of the vehicle, etc., and confirm and sign the “report on the safety inspection of passenger ships prior to departure” prepared and submitted by the captain, and keep the inspection report in the operation management office for a period of three months, and record and keep the details of information, inspection matters, pointed out, etc. after conducting on-site inspections for the safety of passenger ships prior to departure from port.

The head of the operation management office shall examine the “report on the safety inspection of passenger ships prior to departure” and “report on the visit of boarding ships” prepared by operation managers, check whether the operation management situation is abnormal, and then approve the “report on the visit of boarding ships”. The head of the Korea Shipping Association Headquarters and the Commissioner of the Korea Coast Guard shall report the operation management status of passenger ships to the Commissioner of the Korea Coast Guard.
