A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No person shall publish any false information about a candidate in a manner unfavorable to the candidate by means of a speech, broadcast, newspaper, communication, magazine, poster, propaganda document, or other means, with the intention of preventing the candidate from being elected, and slander the candidate by openly pointing out any fact.

At around 14:00 on April 10, 2016, the Defendant provided a press conference with the content that he provided systematic entertainment, such as providing meals, to the executives of the Organizing Committee in the 20th National Assembly member election that was scheduled to take place on April 13, 2016, for the purpose of preventing the election of the candidates for the D political party in connection with the 20th National Assembly member election that was scheduled to take place on April 13, 2016 (hereinafter “the instant press conference”). The Defendant distributed news report materials with the following contents (hereinafter “the instant press conference”). The press conference E provided systematic entertainment.
