A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Reasons

Punishment of the crime

The Defendant is an employer who runs Q Q Co., Ltd. established for the purpose of building a ship by employing 30 full-time workers in P in the Y, and is a representative director of Q Q.

1. The Defendant, from October 1, 201 to December 12, 2014, did not pay KRW 13,289,820 of RR wages of retired workers from work in Q, and retirement pay KRW 7,622,081 of the retirement allowances, as shown in the attached Table 1 to 5, 8, and 9 of the daily table of crimes (1) of the attached Table 2, including the Defendant’s failure to pay KRW 86,76,505, total amount of wages, retirement allowances, and KRW 86,76,505, within 14 days from the date of retirement without an agreement between the parties on the extension of the payment period between the parties.

2. The Defendant did not pay KRW 7,519,500 of wages of N of retired workers who worked in Q from around July 9, 2014 to September 30, 2014, as well as KRW 20,217,000, total amount of wages of four workers, as shown in attached Table (2) 6, 8, 9, and 10, as in attached Table (2) 6, 8, 9, and 10.

3. The Defendant, who worked in Q Q from August 16, 2013 to March 31, 2015, did not pay KRW 29,410,520 of the retired worker S wages, retirement allowance of KRW 5,372,52 of the retirement worker S within 14 days from the date of retirement without any agreement between the parties on the extension of the payment period.

4. The Defendant did not pay KRW 24,626,890 of wages and retirement allowances of three workers, as shown in the attached crime list (3) as well as the payment of KRW 50,898,395 of wages and retirement allowances of three workers from around April 2, 2014 to February 20, 2015, within 14 days from the date of retirement without any agreement on the extension of the payment period between the parties.
