1. Of the 740 square meters in Chungcheongnam-gun, Chungcheongnam-gun, Gyeongnam-gun, the Defendant each point of Attached Table 1, 2, 3, 4, 5, 6, 7, 8, and 9, written in annexed Table 1.
Reasons
1. The following facts can be acknowledged in light of the results of the on-site inspection and appraisal of evidence Nos. 1 to 15 of the basic facts, as a result of the survey and appraisal conducted by appraiser D, as a whole.
The land mentioned in this case is the location of the attached Form 3 appraisal map as the following three parcels.
The “instant F land” of this case, one of which is one of the instant F land, located in Gyeong-gun, Busan-gun, Busan-gun, Busan-gun, and one of which is one of the following: H land of this case (hereinafter “instant F land”) located in Gyeong-gun, Busan-gun, Busan-gun, and one of which is one of the instant H land of this case;
A. On June 17, 2014, the Plaintiff completed the registration of ownership transfer with respect to the Plaintiff’s land to newly construct a house, and acquired the ownership thereof. The instant F land was considered to have been considered in the name of F and is written on the land cadastre.
B. The current status of access road was a public road, such as the attached Table 3 appraisal map, which is a part of the original map, and was established by linking the land of this case to the land of this case for access to the land of this case (not until 1.8m through 3m). However, the current status of the road of this case was over the right side of the road in the cadastral map by the land of this case and the building on the ground of the land of this case (hereinafter referred to as the “side direction”). The current status is based on the attached Table 3 appraisal map. The current status is that the boundary is adjacent to the boundary of the F land of this case. The current status is in fact impossible to restore the road according to the boundary in the cadastral map due to the fact that the boundary is at high level facing the boundary of the F land of this case, and the current status of the road of this case is in the shape of a valleyed line with the left side.
