Reasons
Punishment of the crime
"2013, 2772"
1. On January 22, 2013, at around 07:32, 2013, the Defendant acquired 12,200 won by deceptioning 12,200 won by driving a taxi to the front roads of Jung-gu, Busan, and the 200 won by driving the taxi to the front roads of Jung-gu, Busan, and the 55 years old at the taxi of the victim C (the 55 years old), who is a taxi driver, to arrive at the destination, as if he would pay for the taxi expenses.
2. On the 29th day of the same month, the Defendant, at the F cafeteria located in Busan Dong-gu, Busan at around 08:15, by means of fraud as if the Defendant would pay the F cafeteria price to the victim G (53 years old) who is the owner of the dong-gu, Busan, and by fraud, acquired the price by fraud from the Dong-gu who believed it as true and would not pay the amount equivalent to KRW 4,500.
around 12:30 on January 30, 2013, the Defendant had no intention or ability to pay the price, even if he/she orders food, etc., within the radius of the “J” operated by the victim I located in Jung-gu Busan, Busan.
Nevertheless, the Defendant, as if he were to pay the amount, by deceiving the victim, was provided by the victim with an amount equivalent to KRW 5,500, the sum of KRW 9,500 per person per 1 dubed, per 4,000.
Even if the Defendant did not have the intent or ability to pay the taxi fee even if he was on a taxi, the Defendant, around 07:20 on January 23, 2013, operated as if he would pay the taxi fee in the K Apartment-gu, Busan at the time of 07:20 on January 23, 2013, and did not pay 12,000 won of the taxi fee after he was on a cab operated by the victim L (the age of 45) to the front-dong of Busan Dong-gu, Busan.
After all, the Defendant, as above, by deceiving the victim, obtained pecuniary benefits equivalent to 12,000 won of taxi fares.
