A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. On March 2014, at the beauty art room operated by the Defendant on the Busan Shipping Daegu B and the first floor, the Defendant: (a) operated a beauty art room using the victim D’s “C” worth KRW 180,000,000 for the interior fee of KRW 100,000; (b) leased the said beauty art room at KRW 100,000 per month and KRW 6,000 per month; and (c) made a net profit of KRW 20 million at KRW 10,000 per month and KRW 10,000 per month. The Defendant stated that the beauty art room is able to serve in the position of the head of the headquarters, and at any time, returned at any time, and provided deposits as security.”
However, in fact, the lease deposit of the above beauty art room was only KRW 40 million, and the owner of the building has paid KRW 5 million per month for the test cost, and the owner of the building has paid KRW 5 million per month for the test cost, and there was no intention or ability to repay even if he borrowed KRW 60 million from the victim due to the continuous accumulation of the enemy.
As above, the Defendant, as the victim’s false statement, received a total of KRW 60 million from the victim’s bank account (Account Number: E), KRW 10 million on April 1, 2014, KRW 5 million on April 11, 2014, KRW 5 million on April 16, 2014, and KRW 60 million on April 24, 2014, respectively.
2. On April 22, 2014, the Defendant forged private documents: “one floor in the city of Busan Metropolitan City, Busan Metropolitan City, F1st floor in the port of location”; “one floor in the leased section column”; “100,000” in the column of deposit; and “6,00,000 won shall be paid on the 15th of each month on the 15th day of the date of preparation” in the column of the date of preparation; “The 6,00,000 won shall be paid on the 15th day of December 1, 2013; “G” written in the column of the lessor’s name; and “G” printed out in the column of the lessor’s name with the “G” and affixed a seal thereon prior to the lessor’s name.
