Punishment of the crime

The defendant is a person who is engaged in driving a small-type taxi B.

On August 8, 2016, the Defendant driven the above taxi on August 13:50, 2016, and led to the left turn to the right turn from the front of the Paris Park 363-dong, Yangcheon-gu, Seoul to the direction of the wooden Library.

Since the location was installed at a crosswalk without signal lights on the front door, the driver had a duty of care to check whether there is a person who gets on the road by temporarily stopping in front of the crosswalk, and to safely drive the road.

Nevertheless, the defendant neglected this and got the victim to go beyond the road by taking the right side part of the victim C who crosses the crosswalk from the left side of the taxi into the front side of the defendant's taxi.

In the end, the Defendant suffered damages of the 1st u cage of a single cage, other than the 1st cage cage cage, which requires the victim's stability for about four weeks due to the above occupational negligence.

The Defendant alleged that “the kickboard is not a pedestrian stipulated in the Act on Special Cases Concerning the Settlement of Traffic Accidents.” However, considering the following circumstances acknowledged by the evidence of the judgment, the Defendant’s assertion that the kickboard is merely a kind of play apparatus or a simple pedestrian aid device aground and driving on the ground, and that the legislative purport of the provisions of the Act on the Obligations for the Protection of Pedestrians is to strengthen the driver’s duty of care for pedestrians passing along the crosswalk and to protect the safety of pedestrians’ lives and bodies.
