1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The status of the parties is the company producing the peltop and the peltop boxes. C Co., Ltd. (hereinafter “C”) is a company manufacturing paper boxes, such as Gatop boxes, using the peltop group. Defendant A is the manager of C, and Defendant B is the vice-director of C’s accounting division.
B. On February 5, 2015, the Plaintiff entered into a contract with C on the supply of the C, and the Plaintiff to supply the C the C the C the C the C the C the C the C the C the C the purchase price. The Plaintiff supplied approximately KRW 1.2 billion to C the C the C the C the purchase price of the C the C the C the C the purchase price of the raw materials, from February 5, 2015 to July 6, 2015, but did not receive approximately KRW 800,000,000,000 from February 5, 2015.
C. On July 2, 2015, C transferred, to the Defendants, the claims listed in paragraph (2) of the attached Table No. 2, the claims listed in paragraph (3) of the attached Table No. 4 against the Sungsan Packaging Co., Ltd., the claims listed in paragraph (4) of the attached Table No. 4 against the Jinsan Packaging Co., Ltd., the claims listed in paragraph (5) of the attached Table No. 5 against the Jinsung limited liability company, the claims listed in paragraph (6) of the attached Table No. 6 of the new nature packing, and the claims listed in paragraph (7) of the attached Table No. 7 against the Bosungwon Budget Branch Distribution Center, respectively, and on July 6, 2015, C notified each of the above obligors of the above assignment of claims on July 7, 2015 to the Defendants on July 7, 2015 (hereinafter referred to as the above assignment of claims and the “instant assignment of claims”).
[] On July 8, 2015, the Defendants notified the oil business corporation of the above assignment of claims. D. The Defendants received the transfer amount from the debtors of each of the claims listed in the separate sheet after the instant assignment of claims. The Defendants received KRW 162,909,570 in total from the debtors of the claims listed in the separate sheet after the instant assignment of claims.
