1. The Defendant shall pay to the Plaintiff KRW 170,378,082 and the interest rate of KRW 20% per annum from April 24, 2014 to the date of full payment.
Reasons
1. Basic facts
A. On February 2011, the Plaintiff entered into a business investment agreement with C (hereinafter “C”) and paid C the following money with the investment amount. The Defendant, as the representative director of C, guaranteed the duty to return the said investment amount.
(1) Date of payment: On February 11, 201, the amount to be paid: KRW 400 million, and date of payment: February 10, 2012; ② Date of payment: KRW 300 million; due date: KRW 300 million; and due date: July 11, 201: July 10, 2012; ③ Date of lending: February 10, 2012; KRW 300 million; and KRW 300 million: August 31, 2012 (hereinafter referred to as “agreement”); and collectively, the agreement in this case shall be concluded).
C and the Defendant, on February 10, 2012, which was the due date at the time of the first agreement, paid the principal of KRW 600 million including the principal of KRW 400 million and KRW 200 million, which was the due date at the time of the second agreement, KRW 450 million including the principal of KRW 300 million and KRW 150 million, which was the due date at the time of the second agreement, and KRW 20 million including the interest at the rate of KRW 30 million, which was the due date at the time of the third agreement at the time of the third agreement, but failed to implement it.
C. Pursuant to the instant agreement on January 16, 2013, the Plaintiff and the Defendant agreed to provide C and the Defendant with the real property as collateral for the Defendant, as follows: (a) KRW 1,55,512,329 out of the total amount to be repaid by June 30, 2013; (b) KRW 800 million, namely, KRW 65,50,000,000 of the principal under the agreement under paragraph 1 and the principal amount to KRW 200,000,000 under the agreement; (c) KRW 755,512,329 (the principal amount to KRW 55,512,329) out of the total amount to be repaid by June 30, 2013; and (d) KRW 205,512,329,000,000,0000,000 from June 30, 2013.
Principal and Interest Details: 1.350,000,000 won including the sum of the investment funds and proceeds under the agreement under paragraph (1), the investment funds and proceeds under the agreement under Article 2, the amount of KRW 450,000,000,000,000,000 won, and the leased principal under the agreement under Article 3;
