1. The Defendant: (a) KRW 13,070,000 for the Plaintiff and KRW 5% per annum from July 19, 2014 to February 13, 2015.
Reasons
1. Facts of recognition;
A. On March 26, 2014, in order to use the vehicle for business purposes, the Plaintiff’s number of one vehicle per 2014 Audio A84.2 TDI vehicle from the Character Capital Korea Co., Ltd. (hereinafter “Character Capital”).
B. hereinafter referred to as “instant vehicle”
2) On March 26, 2014, the lease period of KRW 2,835,140 per month, and the lease period of KRW 2,835,140 from March 25, 2018, the Plaintiff’s representative director C leased the instant vehicle from March 26, 2014 to March 25, 2018. On May 26, 2014, the Plaintiff’s representative director C used the instant vehicle driven by Plaintiff’s staff D and stopped at the edge of the instant vehicle abutting on India at the crosswalk of the subway 11 located in Seongdong-gu, Seongdong-gu, Seoul, Seongdong-gu, Seoul, and was stopped at the right edge of the instant vehicle, the banner board (the form where the pipe pole is attached to the ground), which was installed at the right right edge of the invasion, was used as the front side of the instant vehicle, and the structure of the upper part of the instant vehicle installed at the top (hereinafter “the front part of the instant accident”).
c. The above banner display stand (hereinafter “instant display stand”)
A) The Defendant installed and managed the banner for public relations in the Gu affairs at around 10 years to be used by the Defendant. On June 4, 2014, three placards for public relations activities of candidates who were going to run nationwide and local elections at the 6th day of the instant accident were put to two sides of the instant bulletin board and the adjacent traffic signal pole, etc., and were used as above. [Grounds for recognition] The fact that there was no dispute, Gap 1, 2 evidence (including a serial number, Eul 7 through 12 evidence), and the purport of the entire pleadings as a whole.
2. Determination:
(1) Article 5 of the State Compensation Act is established.
