Defendant
A shall be punished by imprisonment with prison labor for ten months and by imprisonment for eight months, respectively.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
【Defendant A’s criminal records” was sentenced to three years of imprisonment with prison labor for embezzlement, etc. on February 7, 2014 and four years of suspended execution on May 22, 2014, and is still under suspended execution as the said judgment became final and conclusive.
【Defendant A is the president of the medical corporation Foundation established around April 7, 2006. Defendant A established around February 20, 2008. Defendant A is the president of the medical corporation, from around February 20, 2008 to around January 15, 2010, and from around October 201, Defendant A opened the FF Hospital’s entrance and exit points, up to December 27, 201. Defendant B is the president of the medical corporation established from around 2006 to around 14, 200, who was in charge of overall business of each hospital, including the operation, accounting, patient management, and claim for insurance proceeds. Defendant B is the president of the G medical corporation Foundation established from around December 20, 201 to around 20, Defendant A’s overall operation and exit points from around 14, 200 to the 20th day of December 27, 2012, Defendant B is the president of the G medical corporation Foundation’s general operation and exit from each of the hospital.

Defendants, in collusion with H, are excellent employees in attracting patients every month in preparation of the EG Medical Foundation Accounting System.
