A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On April 3, 2015, the Defendant posted an article stating that he sells a mobile phone machine of 6 mobile phone at the 2015 French site, and falsely concluded that he would send the article first to the victim C who reported and contacted, if he first transfers the price to the victim C.

However, in fact, the defendant did not have a mobile phone device and tried to use the above money for the cost of living, so there was no intention or ability to deliver the above goods to the victim.

The Defendant, by deceiving the victim as above, received KRW 70,00 from the victim to the Agricultural Cooperative (D) account under the name of the Defendant as the price for the goods at that time, and received KRW 1,272,600 in total from June 2, 2015 to June 11, 2015 by deceiving 11 victims by the same method, as shown in attached Table 1 of Crimes List 1.

"2016 Highest 5210"

1. On March 13, 2016, the Defendant posted a notice on the Internet NAVER car page “NGGE” with a smartphone, stating that the Defendant would sell Samsung Tgalian 3, and reported this fact to the victim E who contacted the Defendant, saying, “on receiving 130,000 won of the price of the goods, the Defendant would promptly send the goods to the house.”

However, since the defendant did not have the above goods, even if he received money from the victim as the price for the goods, he did not have the intention or ability to send the goods to the victim.

Nevertheless, the Defendant deceiving the victim as above and received 130,000 won in the same day from the victim.

2. On April 15, 2016, the Defendant, using smartphones, posted a notice to sell Samsung Tallonian 3 on the Internet NAVER car page, and reported this fact to the victim F who contacted the Defendant, “130,000 won of the price of the goods,” and then, the Defendant’s door-to-door sales of the goods.
