The defendant is innocent. The summary of this judgment shall be notified publicly.
Reasons
1. The summary of the facts charged is that the Defendant runs a fishery products distribution business, such as wholesale supply of fishery products in the trade name of "C" in Ulsan-gu B.
Any person who intends to run food transportation business (business of sanitary transportation of foods that can be decomposed or deteriorated, such as plastic beverages, fish, birds, and products processed therefrom) shall report to the head of the competent Si/Gun/Gu, etc. after meeting certain standards for facilities, such as transportation facilities, tea facilities, teas, and offices.
Nevertheless, from June 7, 2012 to June 26, 2013, the Defendant, while carrying on food transportation business, such as transporting the frozen fishery products, such as the said place of business, name tag, back water, butts, shacker, shacker, shacker, shacker, etc., to the restaurant located in Ulsan City and 80, and distributing them for wholesale, without satisfying the facility standards, did not report food transportation business to the head of Ulsan-gu, Seoul Metropolitan Government.
2. Determination
(a) Any person shall collect, manufacture, process, use, cook, store, subdivide, transport or display foods or food additives for the purpose of sale (including offering such foods or food additives to many, unspecified persons for purposes, other than sale; hereinafter the same shall apply);
(2) Apparatus, containers and packages used for business purpose shall be handled cleanly and sanitarily.
(3) Standards for the sanitary handling of foods, food additives, apparatus, containers or packages (hereinafter referred to as "foods, etc.") under paragraphs (1) and (2) shall be prescribed by Ordinance of the Prime Minister.
Article 36 (Standards for Facilities) (1) Any person who intends to conduct the following business shall have facilities meeting the standards for facilities prescribed by Ordinance of the Prime Minister:
1. Manufacturing, processing, transporting, selling and preserving foods or food additives;
2. Manufacturing apparatus, containers or packages;
3. Details of business under the subparagraphs of paragraph (1).
