The prosecution of this case is dismissed.

1. The summary of the facts charged is that the defendant is currently serving in divorce proceedings between the victim C (37) and his/her husband and wife or between his/her husband and wife.

On February 2, 2017, around 20:10, the injured party waiting to look at women and movies known to the ordinary cGV in Mapo-gu Seoul Metropolitan Government on February 2, 2017.

The Defendant’s face was assaulted twice by misunderstanding the Defendant’s face by force on the ground that he/she avoided disturbance, such as raising a large interest.

As such, the Defendant assaulted the victim with the face and part of the victim several times, who would be able to take advantage of the victim’s face and part of the victim.

2. Determination

(a) Applicable legal provisions: Article 260(1) of the Criminal Act;

(b) Crimes of non-violation of intention: Article 260 (3) of the Criminal Act.

C. On August 24, 2017, after the prosecution of this case, the victim presented his/her opinion that he/she does not want to be punished by attending the court as a witness.

(d) Judgment dismissing a public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
