A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On June 2010, the Defendant, who was in charge of the D building owned by the victim C, had, without the consent of the victim, moved the rental deposit for the garage of the first floor of the D building into the existing KRW 10 million from the existing KRW 10 million to the KRW 20 million from the previous KRW 20 million to use it at will.

1. On July 1, 2010, the Defendant forged a private document at the F Licensed Real Estate Agent Office located in Busan Jung-gu, Busan, stating “B0 million won” in the deposit column and “C” in the lessor’s name, and affixed C’s seal prior to custody in the name of C.

Accordingly, for the purpose of exercising, the Defendant forged one copy of the real estate lease contract in the name of C, which is a private document on rights and obligations.

2. The Defendant: (a) delivered a forged real estate lease contract to G with the lessee who is aware of the forgery at the same place; and (b) exercised it as if the contract was duly formed.

3. The Defendant, from Jun. 2010 to Jun. 201, managed D building owned by the victim C in Busan Jung-gu, Busan. A.

On July 1, 2010, the Defendant received the lease deposit amount of KRW 10 million from the above lessee G on the first floor of the D Building in Busan Jung-gu, Busan, and stored it for the victim, and embezzled by consuming it in the manner of living expenses, etc. around that time.

B. On March 9, 2011, the Defendant: (a) transferred KRW 1,721,00,000 to the Agricultural Cooperative Account in the name of the Defendant’s father’s H as the construction cost for remodeling of the housing in the fifth floor of the D building from the victim; and (b) embezzled for the victim by consuming KRW 8 million under the name of living expenses, etc. around that time, for the victim.

C. From August 30, 2010 to May 31, 2011, the Defendant received monthly rent of KRW 15 million from 10,500,000 from 2nd floor lessee I of the said D building over a total of ten occasions, and kept in custody for the victim.
