The prosecution of this case is dismissed.

1. On June 20, 2013, the Defendant assaulted the victim’s face at one time by making the victim’s face one time at the front side of Sinpo City B (23 years of age) around 04:45 on June 20, 2013.

2. The facts charged in the instant case are crimes falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the victim’s express intent pursuant to Article 260(3) of the same Act. The victim expressed his/her intention not to prosecute the Defendant in this court on November 15, 2013, and thus, this part of the prosecution is dismissed pursuant to Article 327(6) of the Criminal Procedure Act.
