1. The Defendant shall pay to the Plaintiff KRW 40,00,000 and the interest rate of KRW 15% per annum from August 26, 2017 to the day of complete payment.

1. Determination on the cause of the claim

A. The construction site of the new construction site of the main complex building on land C and 15 lots from the Defendant around 2016, when the Plaintiff engaged in the construction business under the trade name “B”

C. I. P.P. Construction has been subcontracted in the amount of KRW 66 million and completed and received KRW 26 million around January 26, 2017, may not be disputed between the parties, or may be recognized by the statement in the evidence A Nos. 1 and 2.

B. Therefore, the Defendant is obligated to pay the Plaintiff the interest for delay calculated at the rate of 15% per annum from August 26, 2017 to the day following the delivery date of a copy of the complaint, which is the date of delivery of the payment for the construction cost to the Plaintiff, to the day of full payment.

2. It is so decided as per Disposition by the assent of all participating Justices on the ground that the plaintiff's claim is reasonable.
