A defendant shall be punished by imprisonment for four years.
The defendant is 4,400,000 won by fraud to C who is an applicant for compensation, and D who is an applicant for compensation.
Reasons
Punishment of the crime
1. From around 2008, the Defendant had operated a State agency from around 2008 to around 153 of the Seoul Special Metropolitan City Nowon-gu GG Building 153, the Defendant: (a) from around 2010 to around 2010, “defensively used to pay the unpaid travel amount of the existing customers due to cumulative debt accumulation; (b) around 2012, the amount of the accumulated debt exceeds KRW 100 million and used bonds; and (c) around May 2013, the amount of the existing customer’s unpaid travel amount with the headquarters exceeds KRW 350,000,000; (d) from around May 2014, the Defendant was terminated to the agency from the head office of H; and (d) from around operating the State agency at the same place, the victims did not have the ability to receive or return the accumulated travel amount from the victims as a credit card purchase price, flight ticket purchase price, loan money, or purchase money for the preceding century, but did not receive the existing customer travel payment or pay.”
Around October 8, 2013, the Defendant, at the above Defendant’s office, made a false statement to the VictimJ stating that “to send an overseas trip from three European countries,” and that is in its jurisdiction, KRW 900,000 to one bank account under the name of the Defendant on October 8, 2013, KRW 2,000,000 to the post office account under the name of the Defendant on January 4, 2014, and KRW 843,800 in total transferred to the agricultural bank account under the name of the Defendant on July 1, 2014, and received KRW 3,743,800 in total from that time until August 7, 2014, the Victim’s Compensation Order No. 43 of [Attachment 1] List of Offenses 1 to that of the Defendant was obvious in light of the evidence record and application form, etc.
The sum of KRW 428,225,00 shall be remitted or carded 55 times from the victims.
