【The Defendant was sentenced to six months of imprisonment for fraud at the Incheon District Court on October 10, 2014, and completed the execution of the sentence at the Incheon Detention House on August 10, 2015.

[Criminal Facts]

1. Around April 2016, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Embrye players) was to lend KRW 23.5 billion of existing loans secured by B building from C representative D at the coffee shop in Seocho-gu Seoul Metropolitan Government.

Upon receipt of a request from another bank to grant a loan of KRW 27 billion, the bank agreed to allow D to get a loan of KRW 27 billion and to receive a loan of KRW 27 billion as a fee.

Accordingly, the Defendant colored the savings bank and subsidized E with the expenses incurred in lending operations, and the F and G received a loan equivalent to KRW 27 billion from H banks, I banks, J banks, K banks, L M banks, N M banks, N banks, and O banks on May 17, 2016, around 2016, the Defendant received a loan of KRW 378 million from D to the Defendant’s account as a loan intermediary fee.

As a result, the Defendant received money and valuables for arranging matters belonging to the duties of executive officers and employees of financial companies.

2. On May 18, 2016, the Defendant: (a) distributed KRW 100 million to E, out of the loan brokerage fees that received remittance from D; (b) however, the Defendant had been willing to bring about a false complaint against E by having an omission between E and E receive a return.

On December 20, 2016, the Defendant acquired KRW 100 million as a loan for business funds from E on May 18, 2016, for the purpose of having E criminal punishment imposed by the Incheon Central Police Station.
