A defendant shall be punished by imprisonment for six months.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

Punishment of the crime

On February 18, 2020, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (or intrusion by a public official with a sexual purpose) at a Suwon District Court’s Eunpyeong site, and the judgment became final and conclusive on May 7, 2020.

1. On October 30, 2019, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (including entry of places in public use for sexual purpose) entered the Defendant’s cell phone with a view to taking the studio of women in the first floor of the commercial building B in Ansan-si around 20:50 on October 30, 2019.

Accordingly, the defendant invadeds on women's toilets, which are public use places used by many unspecified persons for the purpose of meeting his sexual desire.

2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and photographing);

A. On October 30, 2019, at around 20:55, the Defendant taken pictures of the victim’s booming images, using the recording function of the camera of a mobile phone owned by the Defendant, in which the female victim in the name unexplosion in the name unexplosion column is viewed as a booming photo of the victim.

B. On October 30, 2019, at around 22:56, the Defendant sought to photograph the appearance of the victim C(s) in the side gate column by using the recording function of the camera of a mobile phone owned by the Defendant, but was exposed to the victim and did not constitute an attempted crime.

Accordingly, the defendant taken or attempted another person's body, which may cause sexual humiliation or shame on the defendant's cell phone camera, against his will.
