1. As to KRW 150,00,000 from the Plaintiff and KRW 50,000 among them, the Defendant shall pay for KRW 150,00,000 from May 13, 2014, and KRW 100,00,00.

A. On May 13, 2014, the Plaintiff concluded a sales contract with the Defendant for the land indicated in the separate sheet (hereinafter “instant land”) with the amount of KRW 800 million. The main contents of the sales contract are as follows.

Article 1 The Defendant shall pay the Plaintiff the down payment of KRW 50 million out of KRW 800 million per contract day, KRW 100 million in intermediate payment on August 3, 2014, and KRW 650 million in the remainder on December 16, 2014, respectively.

Article 2 Upon receipt of the balance of the purchase price, the Plaintiff shall cooperate with the Defendant in the procedure for the registration of transfer of ownership rights to the instant land, and the delivery date of the said land shall be December 16, 2014.

Article 3 If there is a reason to restrict the exercise of ownership, such as mortgage, superficies, lease, etc., established on the land of this case, the Plaintiff shall transfer to the Defendant full ownership by removing the defects and burdens of the rights by the balance.

Provided, That this shall not apply to the rights and amount agreed to succeed.

*Special Agreement - The farmland diversion charges unpaid by the Plaintiff shall be settled on the balance date.

- The defendant shall pay interest accrued after the remainder of the payment.

- The Plaintiff shall settle the seizure, establishment, etc. of the instant land until the remainder, and shall be liable to the Plaintiff when violated.

- The amount of loans shall be paid with the exception of loans indicated in the register.

피고는 원고에게, 위 계약당일 계약금 5,000만 원을, 2014. ８. 3. 중도금 1억 원을 각 지급하였고, 2014. 6. 20. 안성시장으로부터 이 사건 토지와 안성시 B, C, D 토지에 관하여 별지 건축허가 내역 기재와 같이 건축허가를 받았다.

On October 16, 2014, the Defendant issued a written confirmation to the Plaintiff on October 16, 201, to KRW 100 million out of the balance 650 million on the same day, KRW 50 million through KRW 100 million out of the balance 50 million on November 16, 2014, and to the remainder on December 16, 2014, and to waive all rights in the event of nonperformance.
