Punishment of the crime

가. 피고인은 2013. 12. 하순 02:30경 부산 금정구 C에 있는 피해자 E(여, 55세)이 운영하는 주점에 찾아가 그 전 일행들과 함께 술을 마신 후 일행이 신용카드로 결제한 술값에 대해 피해자에게 세금계산서 발행을 요구하다가 위 피해자로부터 카드로 결제를 한 것이기 때문에 별도로 세금계산서를 발행해 줄 수 없다고 거절을 당하자, 피해자에게 “씨발년아, 신고해 버릴까, 내가 교도소 나온지 얼마 되지 않았는데 칼로 쑤셔 죽이삔다”라고 큰 소리로 욕설을 하고 주점 출입문을 발로 차는 등 약 20분 동안 소란을 피워 위력으로 피해자의 영업을 방해하였다.

B.
