피고인은 2013. 10. 29. 23:00경 당진시 B에 있는 피해자 C가 운영하는 D모텔 복도에서 피해자가 자신에게 불친절하게 대했다는 이유로 모텔 내 정수기 위에 있던 플라스틱 커피잔을 카운터 앞 계단에 던지고, 피해자에게 “씨발 좃같네, 손님은 왕인데 너 이 새끼야 나 무시하냐”라고 욕설을 하여 피해자가 카운터 내로 자리를 피하자, 카운터 문을 발로 차는 등 소란을 피워 모텔에 들어오려던 손님들이 들어오지 못하게 함으로써 위력으로 피해자의 모텔영업 업무를 방해하였다.
