A defendant shall be punished by imprisonment for a term of one year and two months.
Reasons
Punishment of the crime
1. On December 2, 2012, the Defendant stolen 4 copies of credit cards and one physical card owned by the victim from around December 2, 2012 to May 2013, 2012, as indicated in attached Table 1-4, from around December 2012 to around May 2013, the Defendant stolen 4 credit cards and one physical card, which are owned by the victim, from “E” operated by C Victim D, and from “E” operated by the victim during his/her service as an employee, he/she stolen by putting together with one L/C, the victim’s possession, which was in the victim’s household.
2. From May 13, 2013 to August 7, 2013, the Defendant: (a) cut off KRW 3,4510,00 won in total on 43 occasions, including the following contents: (b) from April 30, 2013 to August 7, 2013: (c) the Defendant, at a point located in the camping tower of the branch bank in Sungnam-si, Sungnam-si; (d) the Defendant, who was established at that point, made cash payments of KRW 1 million by using the Samsung Bio-Ba that was stolen, using the stolen Samsung Bio-Ba that was managed by the victim bank; and (e) the Defendant, from around 30, 2013 to around 5-47, 200 won in cash.
3. From January 24, 2013 to July 24, 2013, the Defendant in violation of the Act on the thief and credit finance business: (a) at the point of the Korean Bank Measures Board located in Sejong-si, the Defendant: (b) withdrawn KRW 30,000,000 from the stolen C&C card under the name of cash services; (c) stolen the stolen C&C from January 24, 2013 to July 24, 2013; and (d) used the stolen F&C in total amount of KRW 9,000,000 in cash over 37 times, including the use of stolen credit cards; and (d) used the stolen credit card.
4. On March 25, 2013, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Business: (a) around March 25, 2013, at the victim slot department G department stores, and (b) the Defendant purchased the goods and settled the stolen cards, as seen above, as if the Defendant had a legitimate possession, with the purchase of the goods, 109,000 won.
