Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

A person who intends to implement a construction project of multi-family housing with at least 20 households shall submit an application for approval of a project plan to the competent authority as a person who has human rights to participate in the project, along with the plot plan of housing, incidental facilities and welfare facilities, and design drawings, etc.

When constructing six units of apartment houses in the name of “C” in the name of “C” in the Namyang-si, Namyang-si, etc., the Defendant, without obtaining the above business plan, divided one unit of land into several parcels to obtain a building permit, and thereafter, had the divided land transferred to the name of the owner of each land to build a building with less than 20 households under the name of each owner of each land without obtaining the approval of business plan by constructing a building with less than 20 households under the name of each owner of each land.

In the indictment of 16. “No. 22, 2013.”, “No. 22, 2013.” was obvious in the bill of indictment: (a) the land B in the name of the person who is a clerical error (see, e.g., evidence No. 181; hereinafter the same shall apply) was registered as transfer of ownership in the name of D; and (b) a construction permit was granted from the construction of the Namyang-si’s viewing division on April 30, 2014 to less than 20 households; (c) the construction was implemented with approval for the use of the construction work; and (d) each ownership was granted under the name of the owner of the building and the construction of the building with less than 20 households under the name of the owner of the said land; and

Accordingly, the defendant carried out multi-family housing projects with at least 20 households without obtaining approval of a business plan.
