Reasons
Punishment of the crime
1. Opening a place for gambling in violation of the National Sports Promotion Act (the joint crime committed by the Defendants);
(a) A person who is not an entrusted business entity or a national sports promotion corporation of the Seoul Olympic Games or a person who is not an entrusted business entity shall not engage in an act of offering property or property benefits (hereinafter referred to as "similar act") to a person who correctly predicted the result of issuing sports promotion voting rights (including the publication through an information and communications network) or others similar thereto;
Nevertheless, from May 2, 2015, Defendant A: (a) from around 2, 2015 to a house located in the area of the Philippines; (b) from a site similar to the sports soil, Defendant A issued a sports soil site (in the Internet by issuing things similar to the sports soil, and caused its members to predict the result before holding the games and take money; and (c) from a member who recorded the result, Defendant A leased a kind of gambling site, site name: J and site address: K’s name from a person whose name cannot be known, and operated the said “J” from around that time; (c) Defendant C, D, E, and B, who was employed by the said gambling site, manages the details of money deposited in the said gambling site, and (d) Defendant C, who entered the sports competition situation and the result and distribution rate therefrom, entered the said gambling site into the said gambling site; and (d) Defendant E and his members deposited the said money into the said gambling site and managed the money deposited in Seo-gu’s account.
During the period from May 2, 2015 to early July 2015, Defendants received Do money from members of the said website while managing the said gambling site by computers, and predicted the results of domestic and overseas sports events, such as stables, deaf-gus, and camping districts, before holding the games.
