1. The Defendant shall pay to the Plaintiff KRW 66,121,549 and the interest rate of KRW 15% per annum from October 30, 2018 to the date of full payment.
Reasons
1. Facts of recognition;
A. (1) Around May 2012, the Plaintiff entered into a sales contract to sell the actual container control unit manufactured by C to the Defendant, and supplied it.
(2) The Defendant manufactured and sold the electric power supply system using the parts supplied by the Plaintiff, and the problems arise in the product. As to the Plaintiff’s product, the Defendant filed a lawsuit claiming compensation for damages against the Plaintiff (hereinafter “instant principal lawsuit”) with the Suwon District Court Decision 2017Da40034, Sungnam Branch 200, 400, 234,227 won, and delay damages therefrom, on the ground that “the Plaintiff arbitrarily supplied the parts for which the manufacturing method was modified without the Defendant’s approval, thereby violating its obligations under the sales contract.”
(1) On December 16, 2016, the third debtor 12016Kadan61858, the delivery date of the claim amount for the case name No. 3 debtor / the third debtor / the third debtor / the third debtor / the claim amount, 12016Kadan68 real estate provisional seizure 300 million, Guro-gu Seoul Metropolitan Government D, F building G-22016Kadan6189 claims provisional seizure 200,000,000 won, and the defendant filed an application for provisional seizure and provisional seizure as follows:
