[범행의 내용] 피고인은 2014. 3. 26. 00:20경 용인시 처인구 E에 있는 피해자 운영의 F 호프집 내에서 다시 한 번 잘 지내보자고 제안하였다가 피해자로부터 거절당하자 격분하여, “그럼 너 죽고, 나 죽는 수밖에 없다.”라고 외치면서 미리 준비한 위험한 물건인 망치(전체길이 약 36cm)를 윗옷 주머니에서 꺼내 보여 피해자를 협박하고, 위 망치를 빼앗은 피해자의 머리채를 두 손으로 잡아 넘어뜨려 무릎으로 피해자의 가슴을 누르면서 피해자의 머리를 바닥에 수회 찧게 하고, 다시 의자에 눕혀 목을 누르는 등 때려 피해자에게 약 21일 간의 치료가 필요한 머리 손상 등을 가하였다.
